GENERAL TERMS AND CONDITIONSFOR USE OF THE PORTAL WWW.NOVAPOST.COM
By using the Portal and the services, you agree to these Terms and Conditions for Use of the Portal, including you accept to receive information through SMSs and e-mail. You also provide your consent to the collection and use of certain personal information, for the purposes specified in this Regulation. The following terms will have the meanings assigned to them below, when they are used within these ‘General Terms and Conditions for Use of the Portal www.novapost.com’: postal parcels – goods, with or without commercial value, sent through postal networks; the addressee – a natural or a legal person, to whose address a postal item is sent; the sender – a natural or a legal person, who introduces the postal item into the postal network personally or through a third party; the postal service provider – ‘NEW POST INTERNATIONAL MLD’ LLC, IDNO 1014600029674, headquartered on 3 Barbu Lautaru str., Chisinau municipality, Republic of Moldova; postal services – services intended for the public, consisting in collecting, packaging (if necessary), sorting, transporting postal items and their distribution or delivery to recipients; courier service – collecting, receiving postal items and delivering them through the courier, to the recipient's address, personally to him/her or to the person authorized to receive the postal item; express shipment – a shipment that is collected, packaged, transmitted and distributed by physical means as quickly as possible; postal item – a good having a written address to which it is to be distributed by the postal service provider. This category includes correspondence, as well as printed items (books, catalogs, newspapers, periodicals) and postal parcels that contain goods with or without commercial value; international postal item – a postal item sent from the territory of the Republic of Moldova to an address that is not located on its territory or sent from outside the Republic of Moldova to an address located on its territory; user – a natural or a legal person that benefits from postal services as a sender or a recipient. Applicable legislation – laws and regulations applicable on the territory of the Republic of Moldova; Parties – the Sender, Postal Service Provider and Recipient accordingly, and the ‘Party’ shall mean any of them.
Portal – the website of the Postal Service Provider, the address www.novapost.com, where the Sender registers, creates his/her Profile, applies for sending a postal item and interacts with the Postal Service Provider by exchanging information; Sender's Profile – the Sender's personal account on the Portal, always accessible to him/her, by entering his/her e-mail and the unique password on the Portal.
1. CONFIDENTIALITY OF PERSONAL DATA
1.1 The activity of the Company ‘NEW POST INTERNATIONAL MLD’ LLC, IDNO 1014600029674 is regulated under the Legislation of the Republic of Moldova, including the Postal Communications Law no. 36 of 17.03.2016 and the Law on personal data protection no. 133 of 08.07.2011.
1.2 The Company ‘NEW POST INTERNATIONAL MLD’ LLC, as operator of personal data, is obliged to administer in safe conditions and only for the purposes provided for in Law no. 133 of 08.07.2011 the User's personal data;
1.3 The User's personal data includes all or one of the following categories: surname and name, patronymic, identification number, e-mail address, home address, date of birth, sex, bank details, telephone number, User Profile password provided by the Portal, in order to evaluate the reliability and veracity of the information provided, in accordance with the provisions of the Law on personal data protection no. 133 of 07.08.2011;
1.4 The purpose of processing information containing personal data by ‘NEW POST INTERNATIONAL MLD’ LLC in order to carry out the activity of providing postal services and keeping track of the Users:
- 1preparation of courier reports;
- 2evaluation of the reliability and veracity of information about Users;
- 3performance of marketing studies, advertising or commercial prospecting.
1.5 To achieve these goals, the User is obliged to provide current, complete and correct data, which are indispensable for the conclusion of legal relations. Otherwise, it will not be possible to conclude the legal relation.
1.6 By filling out the Order Form, the Sender expressly and unequivocally consents to his/her personal data being stored and processed by ‘NEW POST INTERNATIONAL MLD’ LLC.
1.7 ‘NEW POST INTERNATIONAL MLD’ LLC will keep this information confidential, except for the information requested by the competent legal authorities.
1.8. In accordance with the provisions of Law no. 133 of 08 July 2011, the User has the following rights: the right to information, the right of access to personal data, the right to intervene on personal data, the right of opposition of the data subjects, the right not to be subjected an individual decision and access to justice.
Protection measures
1.9. Processed personal data are confidential and can only be disclosed under the terms of the Policy of Confidentiality and the legislation in force. All persons, who have access to the data processed by the Operator, undertake to maintain their confidentiality and the protection measures regulated in the unit. It is prohibited to copy information owned by the Operator, including to transcribe, copy by xerox, telephone or other mobile means as described below.
1.10. Administration and monitoring of the physical access is carried out at all points of access to personal data information systems, including actions are taken to violations of the access rules. Visitors’ access is recorded in logs, which are kept in accordance with the Policy of Security. Before granting physical access to personal data information systems, access skills are checked.
1.11. The person who will remove from the Operator's secure perimeter the information printed or otherwise exited from the system, which contains personal data, will ensure that this information is marked with the sample marking specified below, indicating prescriptions for its further processing and dissemination, including the unique identification number of the Operator will be indicated.
1.12. The information, which contains personal data and which is contained on the information carriers, is physically destroyed or transcribed and destroyed by safe methods, avoiding the use of standard destruction functions after reaching the purpose for which this information is processed by the Operator and/or after the end of the term for keeping it, as well as when decommissioning the device on which they are stored (clean the memory of the xerox, memory sticks, discs, etc. before throwing them away, selling them, passing them on to third parties).
2. PLACING THE ORDER ON THE PORTAL
2.1 To place an order through the portal www.novapost.com, the User fills out the request to be contacted by a representative of the postal service provider, by entering personal data. The latter will register the request after the User checks the boxes explaining that he/she:
- 1gives his/her consent to the processing by the postal service provider of the User's personal data;

2.2 To identify the User and confirm the personal data entered, a representative of the postal service provider will call the User and make clear the place and time of filling out the Order Form, complete the Postal Invoice and pick up the postal item.
2.3 All requests, approvals, notifications filled by the User through the Portal after entering, are considered binding on the Parties. The postal service provider has a secure electronic archive consisting of a structured deposit of electronic documents, which ensures their confidentiality, non-repudiation and integrity and which guarantees the probative value of electronic documents over time.
2.4 If it is found out that the information provided by the User is inaccurate or non-compliant, the Portal administrators reserve the right to suspend or delete the User's request concerned and refuse current or future attempts to use the services offered on the Portal.
2.5 The User is solely responsible for the information provided through the online application and is also solely responsible for respecting the copyrights of the content as defined and protected by law. Thus the access to use the portal www.novapost.com may be terminated without prior notice if the User violates the terms of use listed above.
3. CONCLUSION OF THE POSTAL SERVICES CONTRACT
3.1 Requests to be contacted by a representative of the postal service provider can be submitted through the Portal. The representative of the postal service provider provides the User with the documents on paper to be filled out and signed, and namely: the order form and the postal invoice. At the time of acceptance of a postal item in the postal network, an individual contract is considered concluded between the postal service provider and the sender, in accordance with the Civil Code and the Postal Communications Law no. 36 of 17.03.2016.
3.2 The Parties undertake not to disclose to third parties any information arising in connection with the Postal Service Contract , except in the cases provided for by the legislation of the Republic of Moldova.
4. USE OF COOKIES
4.1. The company processes only cookies: per session and fixed ones. The latter are temporary files that remain in the user's terminal until the end of the session or closing of the application (browser). The cookies themselves do not request and do not join other additional information that could lead to the reasonable identification of the visitors. At the end of the Internet session, cookies are automatically deleted.
4.2. The use of cookies and other similar tracking technologies serves - depending on the category of the cookie or other similar technologies has the following purposes:
- 1Technically necessary cookies: cookies and similar technologies without which you will not be able to use our services;
- 2Prefered cookies: actual or perceived preferences of the consumer of postal services. You may delete cookies so that your preferences are not analyzed;
- 3Statistical cookies: generation of anonymous statistics about the use of our services in order to shape them as needed.
- 4Marketing cookies: displaying the relevant advertising content based on your use behavior. The platform user may delete the cookies accepted or installed on the user's device.
4.3. The legal basis for the use of prefered, statistical and marketing cookies and for the use of similar technologies is your consent given in accordance with Article 5(1) of Law no. 133/2011 on personal data protection. The legal basis for the use of cookies and similar technologies necessary from a technical point of view is Article 5(5)(a) of Law no. 133/2011 on personal data protection, i.e. we process your data in order to make our services available to you during the initiation and performance of the contract.
5. COPYWRITE
5.1. It is not accepted to copy, modify, transmit, publish, in any form, the content and graphics of the Portal www.novapost.com.
6. CROSS-BORDER TRANSFER OF DATA
6.1. The affiliation of New Post International to the International Nova Poshta/New Post International Group will determine that the personal data processed in the Record System will be subject to the cross-border transfer of personal data, in order to fulfill corporate requirements, including for marketing purposes, as well as for the purpose of keeping them in servers abroad. The personal data recorded in this record system will be stored on the servers of the Operator, which are located outside the Republic of Moldova. In this sense, the Operator has concluded a Cross-Border Personal Data Transfer Agreement with the authorized foreign Operator, which will regulate in detail the conditions and details of personal data transfer, the rights and obligations of the data importer and exporter.
6.2. The collected data are stored on the servers of the Operator to be stored on the servers located at the registered address of the Data Importer for the purposes of data storage and recovery as a result of collecting the information generated as a result of concluding contracts with customers, as well as for statistical purposes. The data are stored on the servers for as long as necessary under the concluded contract. If the cross-border contract is terminated, suspended or in some other way it is not possible for the Data Exporter to store the data outside the jurisdiction of the Republic of Moldova, then the Operator will temporarily suspend the data transfer. The data are transferred across the border in Ukraine, to the company "NEW POST" LLC, based on the Personal Data Transfer Agreement concluded between ‘NEW POST INTERNATIONAL MLD’ LLC and "NEW POST" LLC.
6.3. The following categories of data will be subject to transfer: surname and name; sex; date and place of birth; signature; digital signature, citizenship, phone/fax, mobile phone, e-mail, (home/residence) address, IDNP; series and number of the identity document; the issuing entity; issue date and expiration date; image; bank data.
6.4. The hosting of the website novapost.com is located in Ukraine and involves a possible cross-border transfer of this data in the mentioned country to an authorized person - Serhii Zimenkov. The following categories of data will be subject to transfer: surname, name, contact phone number, address.
7. FINAL CLAUSES
7.1 The use of and access to this Portal and the information contained therein automatically constitutes acceptance of all terms and conditions set forth above.
7.2 In the event of failure to comply with the mentioned terms and conditions, as well as in case of fraud or other actions that may harm ‘NEW POST INTERNATIONAL MLD’ LLC, the User's access to the services offered by the Portal www.novapost.com may be interrupted or limited.
